**Due to the real-time changes involving product batches, production and supply factors such as component availability, in order to provide accurate product information, specifications and features, The Covert Group may make real-time adjustments to text descriptions and images in the foregoing information pages, so that they accurately match any changes that have occurred to the product or its performance, specifications, indexes, and components of the actual product. Product information is subject to such change and adjustments without notice.


By purchasing any of our products you are agreeing to this in said terms, and although any changes that occur wil be updated to the product immediately, we still ask that you contact us should you experience any differences in design that we may not have mentioned prior to sale.

As we build our equipment here in the UK, then due to the supply of components or the potential lack of them etc, then we may need to change some or all of a product because of this. If this happens and you make an order we will contact you prior to dispatch and ensure you are happy to go ahead. We will be happy to provide you with an email showing the full user manual and updated imagery in order to help you make a more informed decision about your order.

We may revise these Terms as they apply to your order from time to time to reflect changes in relevant laws and regulatory requirements.

If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will arrange a full refund of the price you have paid, including any delivery charges.

  • TERMS & ETHICS POLICY

    By using our site you are entering into an online agreement that you will use our information and products for the legal use of information gathering techniques. Please note that these terms will apply to the sale of each product you purchase either from our website or over the telephone. The Contract between us will only be formed when we send you the Dispatch Confirmation.


    Please note that before placing an order you will be asked to agree to these terms. If you refuse to accept these terms, you will not be able to order any products from us. We take steps to ensure customer confidentiality is maintained at all times whilst visiting and purchasing an item/s through our website.


    Please note that our pricing does not include postage and this will be added onto your cart at the final stage of your order.


    We amend these Terms from time to time as set out in our privacy policy with its last updated review being January 2022..


    Prior to purchase of your order, you are able to either email or call ahead to amend or cancel your order. Please note that should you pay and commit to an order then fail to cancel prior to it being shipped, you will still be charged and the items will still reach you. You are able to send the items back with agreement that you have not opened them and they are in the same condition received as we sent them, with your money being refunded the same day of them being delivered to us.

    PRICING

    Our prices will be as quoted on our site at the time you submit your order. Prices for our Products may change from time to time, but changes will not affect any order you have already placed and as with all prices in our catalogue, leaflets and our website, your items will be shown in Pounds Sterling (£) and include VAT (where applicable) at the applicable current rate chargeable for that time.


    VAT exempt customers outside the UK & EU will automatically qualify for a VAT deduction during the Checkout process. Please note that this can change and we will carefully monitor this situation and amend it accordingly. Further details regarding VAT regulations can be found by visiting hmrc.gov.uk.


    PAYMENT

    Payment for the products and all applicable delivery charges is in advance. We will not charge you until we dispatch your order.


    Unless otherwise agreed the full payment is required with any order or prior to delivery of the goods. Online payments are processed using the Paypal payment gateway.


    PayPal has a global reputation in maximising the safety of credit or debit cards made through online transactions by using encrypted SSL secure socket layers in compliance with the world banking industry.


    Any attempts to use credit cards fraudulently will be handed straight to UK Law Enforcement in the region where the fraud originated. We are committed to our fight against fraud and will prosecute every case to the full extent of the law.


    PRODUCTS THAT USE SERVERS

    Some of our products rely on our servers which are hosted here in the UK. Such items include our GPS/GSM Tracking PCB and our Ghost Wi-Fi camera PCB.


    Our server does not hold any personal information about you or the content you collect when using these items. Our GPS/GSM Tracking PCB will only collect enough information to provide you with your subjects’ tracked locations etc, which can be deleted via the user panel screen when you log in.


    ILLEGAL STATUS OF PRODUCTS

    All responsibility for any infringement of another person or their right to privacy is solely upon the customer.


    As such it is the customer’s responsibility to ensure that the equipment is used in compliance with all Privacy Rights, Human Rights, Civil and Criminal Laws active in the area of use. By accepting these Terms and Terms, and placing an order with us, you agree to take full responsibility for the use of any equipment purchased from The Covert Group.


    TRANSMITTING EQUIPMENT

    Although it is not an offence to manufacture or possess a transmitter in the UK, please know that our GSM PCB, WI-FI Camera PCB and GPS/GSM Tracking PCB are permitted for use. 


    If this equipment is being used by you in another country then it is your responsibility to check whether said equipment is legally permitted to be operated in such a manner, we cannot and will not be held liable for this.

    JURISDICTION AND GOVERNING LAW

    As a consumer, please note that these Terms are governed by English Law. This means a contract for the purchase of products through our site and any dispute or claim arising out of or in connection with it will be governed by English Law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.


    If you are a business, a contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.


    If you are a business, we both irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with a Contract or its subject matter or formation (including non-contractual disputes or claims).

  • PRODUCT BUILD AND GUARANTEE

    We guarantee that your item is built to the highest possible standards and will reach you in full working condition. Please know that as these items are built by hand here in the UK, and you may notice a small deformation on the enclosure due to its build process, or really obscure markings which are caused by the tooling process etc. These cannot be stopped and does not in any way effect the product, its overall look and most certainly not its operational use.


    All goods supplied by The Covert Groups 24month warranty against faults and defects commencing from the date in which you receive the item. We will endeavour to swiftly repair or replace any item which has developed a manufacturers fault within the warranty period.


    The warranty does not cover against misuse of any item or general wear and tear of an item. Under circumstances such as these we invite you to send the item/s back to us to potentially recover the enclosure or amend such wear and tear, but this cannot be guaranteed and we ask that you contact us before sending it back.


    After the warranty period has expired, any returns will be chargeable including any applicable costs for outward and inward shipping, customs, labour and materials costs which must be covered by the consumer.


    We do not exclude our liability:


    - For death or personal injury caused by its negligence;


    - For breach of the terms implied by section 12 of the Sale of Goods Act 1979 and by section 2 of the Supply of Goods and Services Act 1982;


    - For defective products under the Consumer Protection Act 1987;


    - For fraud or fraudulent misrepresentation; or for any other liability which cannot lawfully be excluded.


    ALL ITEMS ARE CHECKED AT 3 SEPERATE STAGE FOR CONFORMITY

    All our items are checked for full functionality and conformity at 3 x stages. These stages are set out as follows;


    STAGE 1) PCB HOOK-UP

    This stage is where the PCB is placed on an Anti Electromagnetic Surface and using Anti Magnetic tools, we hook the PCB up to our computer for complete software and hardware evaluation. This shows the PCB working in its entirety and allows us to move onto stage 2.


    STAGE 2) COMPONENT TEST

    This stage allows us to conduct the same test but with the components attached such as microphone connectors or wiring looms etc. This is given another 100% conformity test ensuring that both the PCB and added components work perfectly, allowing us to move onto stage 3.


    STAGE 3) PRODUCT SIGN OFF

    This shows the product in its complete build stage and then is hooked up to both a charging evaluation board to ensure the charger you use, the PCB and the battery fully conform to British Standards and are 100% safe. We then turn on and use the product fully in its operation phase and ensure that all relevant code, sms, and other parameters such as voice activation or motion detection are completely working.


    The enclosure is tested, the magnetic base is then tested and the product is tested again whilst being magnetised to ensure the base does not conflict with its working operation once sold.


    This process is completely unique to The Covert Group to ensure that your item reaches you in 100% working condition.


    Should there be any issues at all with any product and even at a time that falls after the sale and first 30-60 days of use, then please contact us.


    USER ERROR

    The Covert Group cannot be held responsible for the consumer purchasing an item/s that are incompatible with software or certain operating systems. Whilst we will try to inform of compatibility issues in the product description on our website, we recommend that you contact us to ensure that a product will work with your system.


    We cannot accept responsibility for a user error that may cause damaging side effects to either the product or anything working in conjunction with said product. In this case the user will not be entitled to any form of refund or free replacement.



  • RETURNS & REFUNDS

    As a consumer of our goods you have a right to cancel a Contract, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013], during the period set out below. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the Contract and receive a refund.


     Please note that Products should be unused and returned in their original packaging. Advice about your legal right to cancel the Contract is available from your local Citizens' Advice Bureau or Trading Standards office. However, this cancellation right does not apply in the case of:


     - Any sealed Products once the seal has been removed or broken after you receive them;


     - Any Products tampered with or dismantled, especially electrical equipment would void the Product’s warranty;


     - Any custom build or custom design orders.


     - Your right to cancel the Contract starts from the date of our Dispatch Confirmation (the date on which we e-mail you to confirm our acceptance of your order), which is when the Contract between us is formed. Your deadline for cancelling the Contract then depends on what you have ordered and how it is delivered, as set out below:


     - If you have ordered a single Product (which is not delivered in instalments) the deadline for cancellation is the end of 14 days after the day on which you receive Product.


     - If you have ordered multiple products or a single product which is delivered in instalments, the deadline for cancellation is the end of 14 days after the day on which you receive the last of the separate products or the last instalment of the product.


     - To cancel the Contract, you need to let us know that you have decided to cancel using one of the following methods:


     - The easiest way to cancel is to contact us here at; info@thecovertgroup.co.uk and we can react as quickly as possible to make the correct amendments.


     - If you are e-mailing please include details of your order to help us to identify it. If you send us your cancellation notice by e-mail then your cancellation is effective from the date you send us the e-mail.


     - Your refund will be the price you paid for the products. Please understand that when we receive the order back we will inspect it for conformity. If we find that the packaging has been damaged or any items have been removed or replaced, we will contact you to clarify such findings. If such a thing occurs then we are forced to reduce this from your refund.


     - If you have returned your order to us because they are faulty or not as described, we will refund the price of the products in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us.


     - If you decide to cancel your Contract after receiving the product then you must return it to us without delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the contract.


  • CUSTOM ORDERS

    As The Covert Group’ in-house engineers have a custom department, we have made this process really simple to understand and is set out as follows;


    STAGE 1) REQUEST A CUSTOM ITEM

    Here you will be in contact with us about such task and we will begin to work with you to achieve your desired end result. Once we have agreed the final PCB version and enclosure or product to use then we will move onto stage 2.


    STAGE 2) ORDER CONFIRMATION

    Here you will be required to purchase any agreed enclosure or item and ship it to us. At this stage we still cannot guarantee it can be done as we have to open the product up and ensure we can carry out your desired request without damaging both the product you supplied and the PCB we will be installing. Once we have received the item and given a confirmation, we will move onto stage 3.


    STAGE 3) PAYMENT & LEAD TIME

    As we have agreed the request can be undertaken, we are able to provide you with an estimated time of build. Should this go over the specified time then we cannot guarantee such unforeseen circumstance and will contact you accordingly. Should all go well, we will require full payment prior to carrying out any build in advance.


    Once done, it will be fully tested for conformity and then sent to you via a courier of our choice or you can choose one yourself.


    At the point of dispatch, you are legally entering into our contract which has been laid out above. Should the product be faulty then we are happy to provide a free and full assessment of the product when you ship it back to us.


    If the product is faulty then we will make any repairs for free, but if the product returns to us and is damaged or has been altered in any way then we will bring this to your attention. Should this happen and the fault is down to you then we will provide such evidence and void the refund or free assessment and you will be charged.


    If a customer changes their mind midway through a custom build order, we reserve the right to charge labour costs plus any other additional costs, such as for materials used or ordered for the purpose of the custom build.

  • FORCE MAJEUR

    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an event outside our control. Force Majeure is defined below;


    Force Majeure means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.


    If an event of Force Majeure takes place that affects the performance of our obligations, we will contact you as soon as reasonably possible to notify you. Where Force Majeure affects our delivery of your order, we will arrange a new delivery date with you after such event is over.


    You may cancel a Contract affected by Force Majeure which has continued for more than 30 days. 


    Please contact us at; info@thecovertgroup.co.uk if you opt to cancel. You will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including any delivery charges.
